Data protection information on the processing of applicant data

I. Preliminary remarks

Personal data is all information that relates to you as a person. We process the personal data you provide and transmit to us in the context of your application, which as a rule includes:

  • first name, surname, title and form of address
  • your contact details: contact information such as address, telephone number, fax number, eMail address, professional position if applicable,
  • your application data, consisting of your cover letter, curriculum vitae and the usual supporting documents and certificates.

The office responsible for data processing operations in the course of your application procedure in accordance with Art. 4 No. 7 of the General Data Protection Regulation is:
L.W. Cretschmar Süd GmbH & Co. KG
Reisholzer Bahnstraße 33
40599 Düsseldorf

You are welcome to contact our data protection officer at any time regarding data protection-related issues. The officer’s name and contact details are always published on our company website.

II. General information regarding processing applicant data

In order for us to involve you in the application process for a specific position, you will need to provide us with standard and informative application documents that inform us about your personality profile and qualifications.

As a rule, we only use your application documents to make a decision on whether to fill the position for which you have expressly applied. In the course of the application process, further personal data may be obtained for information purposes from you personally, from generally accessible sources or from former employers and trainers. The legal basis for data processing is Art. 6 (1), sentence 2 letter b in conjunction with Art. 28 of the General Data Protection Regulation and Section 26 (1) of the Federal Data Protection Act. If the application procedure does not lead to your recruitment, we will usually delete and destroy your applicant data as soon as a period of six months has elapsed after the completion of the application procedure for the position in question.

If, however, you submit an unsolicited application that does not relate to a specific position, we can use your application documents as part of recruitment decisions for all relevant positions. We will make the applicant data available in automated searches for selected decision makers in our company so that they can find out about your personality profile and qualifications. In this case, the legal basis for data processing is also Art. 6 (1), sentence 2 letter b in conjunction with Art. 28 of the General Data Protection Regulation and Section 26 (1) of the Federal Data Protection Act. We will normally delete and destroy your application data after a period of six months from the date of receipt of your application, but not before all the application procedures involving your application documents have been completed and after a period of six months has elapsed.

In order to get an overview of our range of applicants, we can statistically evaluate information on incoming applications. To this end, we can also retain anonymised data after deletion of your application, which does not allow us to deduce information concerning your person.

III. Data processing after recruitment

If an application procedure leads to recruitment, we will include your application documents in your personnel file on the basis of Art. 6 (1) Sentence 2 Letter b of the General Data Protection Regulation and Section 26 (1) of the Federal Data Protection Act in order to be informed about your personality profile and qualifications for the purpose of carrying out the employment relationship. In this case, we will inform you in a separate data protection declaration about the further processing purposes and the relevant deletion periods.

IV. Data protection claims

If we process your personal data, you are entitled to various data protection claims against our company. You have the right

  • to request information regarding the data stored about your person and its origin, the purpose of processing as well as the recipients or categories of recipients of the data (Art. 15 of the General Data Protection Regulation and Section 34 of the Federal Data Protection Act),
  • to demand correction, under certain conditions, blocking (restriction of processing) or deletion of your personal data by us (Art. 16-18 of the General Data Protection Regulation and Section 35 of the Federal Data Protection Act),
  • to request the transfer of your data to another responsible authority (Art. 20 of the General Data Protection Regulation) and to complain to us or to a relevant data protection authority about the data processing (Art. 77 of the General Data Protection Regulation).

We fulfil all your rights free of charge and without delay. If you have any further questions, please contact us directly or our data protection officer using the contact details specified above.
